These Terms of Service ("Terms") govern your access to and use of the EasyGarage platform and website at easygarage.com.au ("Service"), operated by EasyGarage ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms, and agree to comply with all applicable Australian laws and regulations.

2. Description of Service

EasyGarage is a cloud-based workshop management platform that provides tools for job scheduling, customer management, invoicing, staff management, and business communication for automotive repair workshops.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised use of your account
• Accept responsibility for all activities under your account

4. Subscription and Payment

• The Service is offered on a monthly subscription basis.
• All prices are in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated.
• Payment is due at the beginning of each billing cycle.
• We reserve the right to change our pricing with 30 days' notice. Founding Member pricing, once locked in, will not be subject to price increases for as long as the subscription remains active.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

5. Free Trial

We may offer a free trial period. During the trial, you have full access to the Service. At the end of the trial, you must subscribe to continue using the Service. We are not obligated to provide notice before the trial expires.

6. Refund Policy

We offer a 30-day money-back guarantee on your first month of paid subscription. If you are not satisfied, contact us within 30 days of your first payment for a full refund. Subsequent months are non-refundable but you may cancel at any time to prevent future charges.

7. Your Data

• You retain ownership of all data you enter into the Service ("Your Data").
• You grant us a limited licence to use Your Data solely to provide the Service to you.
• We will not access, use, or share Your Data except as necessary to provide the Service, comply with legal obligations, or with your explicit consent.
• Upon termination of your account, you may request an export of Your Data within 30 days. After 30 days, we may delete Your Data from our systems.

8. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to the Service or its systems
• Interfere with or disrupt the Service
• Upload or transmit viruses, malware, or harmful code
• Reverse engineer, decompile, or disassemble the Service
• Resell or redistribute the Service without our written consent

9. Intellectual Property

The Service, including its design, features, code, and content, is owned by EasyGarage and protected by Australian and international intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your business purposes during your subscription.

10. Availability and Support

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability. We will provide reasonable notice of planned downtime when possible.

11. Limitation of Liability

To the maximum extent permitted by Australian law:

• The Service is provided "as is" without warranties of any kind.
• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
• Our total liability to you for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Australian Consumer Law.

12. Indemnification

You agree to indemnify and hold harmless EasyGarage from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your account if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Sections related to intellectual property, limitation of liability, and indemnification survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Queensland.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
